IN RE BIGGS, 260 Kan. 632 (1996)

926 P.2d 1325

IN THE MATTER OF J.O. BIGGS, Respondent.

Bar Docket No. 04265Supreme Court of Kansas
Opinion filed August 8, 1996.

ORDER OF DISBARMENT

ATTORNEY AND CLIENT — Disciplinary ProceedingDisbarment.

In a letter dated June 27, 1996, to the Clerk of the Appellate Courts, respondent J.O. Biggs, of Overland Park, an attorney admitted to practice law in the state of Kansas, voluntarily surrendered his license to practice law in Kansas, pursuant to Supreme Court Rule 217 (1995 Kan. Ct. R. Annot. 219).

At the time respondent surrendered his license, there was a complaint pending with the office of the Disciplinary Administrator involving a federal felony conviction in the United States District Court for the Western District of Missouri. In case No. 4:92CR00113-1, respondent was convicted of a felony pursuant to 18 U.S.C. § 1014 (1988), making a false statement to a savings and loan institution. A journal entry of conviction was filed June 8, 1993, but respondent failed to notify the Disciplinary Administrator’s office or the court of this conviction. Respondent tendered his letter of surrender after the complaint was filed March 22, 1996, by the complainant in the disciplinary case.

This court, having examined the files of the office of the Disciplinary Administrator, finds that the surrender of respondent’s license should be accepted and that respondent should be disbarred.

IT IS THEREFORE ORDERED that J.O. Biggs be and he is hereby disbarred from the practice of law in Kansas, and his license and privilege to practice law are hereby revoked.

IT IS FURTHER ORDERED that the Clerk of the Appellate Courts strike the name of J.O. Biggs from the roll of attorneys licensed to practice law in Kansas.

IT IS FURTHER ORDERED that this order shall be published in the Kansas Reports, that the costs herein shall be assessed to
